General terms governing purchases and use of the website

These Terms govern access to www.illustar.art and the purchase of digital illustrations and credit packs. By placing an order, the customer confirms that they have read and accepted them.
1. Seller
Illustar is a trading name of Mirko Grisendi, a sole proprietor with a business address at Via Don Pasquino Borghi 18, 42021 Bibbiano (RE), Italy. VAT no. IT02836770350; Italian tax code GRSMRK72R02H223H; REA no. RE - 317851; email support@illustar.art.
2. Customer eligibility
Purchases may be made by consumers or business customers who are at least 18 years old and have the legal capacity to enter into a contract. Customers must provide accurate, complete and up-to-date information.
3. Territory and availability
Downloads are offered worldwide, except in countries, to persons or for transactions prohibited by law, international sanctions, payment service providers or technical restrictions. Illustar may refuse or cancel an order that cannot be lawfully or technically fulfilled and will refund any amount already collected for that order.
4. Products
At launch, the website sells digital products only: individual JPG illustrations and credit packs. Physical products, shipping, subscriptions and custom commissions are not offered during the initial phase.
Images, colours and previews are illustrative. The binding file specifications are those stated on the relevant product page and on the Downloads & File Support page.
5. Order process
- The customer selects the product, licence and any available options.
- Before payment, the customer reviews the order summary, price, taxes, customer details and the applicable Terms.
- The order is submitted by selecting the button that indicates an obligation to pay.
- The contract is concluded when payment is authorised and Illustar sends the order confirmation, or, for a bank transfer, when the funds are received and the order is accepted.
- The digital content is made available in the manner described in the order confirmation.
6. Prices and taxes
The primary currency is the euro. Displayed prices include VAT where applicable. The final total, applicable taxes and any adjustment based on the customer's country or tax status are shown at checkout before payment.
7. Payments
Payment methods may include Shopify Payments and supported cards, PayPal and bank transfer. Actual availability may vary by country, currency, device and the payment provider's checks. For bank transfers, delivery and activation take place after the funds have been received.
8. Invoices
Invoices are issued on request. The customer must provide the complete information listed on the Payments & Billing page within the applicable tax deadlines. Illustar may request any additional information needed to issue the invoice correctly.
9. Downloads
After successful payment, the download is normally made available immediately by email and on the order confirmation page. Registered customers may also access it from their account area, if that feature is available. Guest customers must retain the email they receive.
10. Licence
Each illustration is governed by the License Agreement and by the Standard or Extended Licence selected. In the event of a conflict, the product-specific and licence-specific terms prevail for matters concerning usage rights; these Terms and any mandatory legal provisions prevail for matters concerning the sale and consumer rights.
11. Credit packs
Unused credits in Core and Selected packs expire exactly 180 days after purchase and do not renew automatically. Where payment is not immediate, the credits become available and the period begins only once the funds have cleared. Expiry of unused credits does not affect the perpetual licence for illustrations already redeemed.
12. Right of withdrawal and immediate supply
Once a download begins, supply of the digital content begins. Where the conditions prescribed by applicable law are met, the consumer loses the right of withdrawal. Illustar nevertheless voluntarily offers a full refund within 14 days of purchase only if the file has not been downloaded or used.
For credit packs, a refund within 14 days of purchase is available only if no credit has been used. Once the first credit has been redeemed, credits still unused in that pack are not refunded and no pro-rata refund of the pack price is available. These voluntary refund conditions do not limit any mandatory right that remains available under applicable law.
13. Refunds and conformity
The rules governing duplicate purchases, incorrect licences, incompatibility, damaged files and refunds are set out in the Refund & Cancellation Policy. Nothing in these Terms limits the legal guarantee or any mandatory remedies for defective or non-conforming digital content.
14. Accounts and security
Account registration is optional for individual purchases. An account is required in order to redeem credits from credit packs: credits cannot be used without signing in. Customers are responsible for keeping their login credentials confidential and must report any unauthorised access. Illustar may suspend accounts used fraudulently or in breach of these Terms.
15. Coupons
Coupons are subject to the terms communicated with each promotion. Unless otherwise stated, they cannot be exchanged for cash or combined with other offers and may be limited to particular products, customers, countries or periods. Coupons do not apply to credit packs, nor to items already covered by credits. Where a promotion sets a minimum spend, that threshold is calculated on the order value before any credits are applied.
16. Intellectual property
The website, previews, text, graphics, catalogue and illustrations are protected by intellectual property law. No content may be copied, extracted, distributed or used outside the applicable licence. The Copyright & AI Policy forms an integral part of these Terms.
17. Website operation
Illustar may update, suspend or modify the website for maintenance, security or service development. Such measures do not affect rights already acquired or remedies available under applicable law. Illustar will provide reasonable assistance in the event of a technical problem.
18. Liability
To the extent permitted by law, Illustar is not liable for indirect loss, loss of opportunity or use of content in breach of the applicable licence. No limitation applies in cases of wilful misconduct, gross negligence, personal injury or mandatory consumer rights.
19. Governing law, jurisdiction and disputes
These Terms are governed by Italian law. Consumers retain the mandatory protections of their country and may bring proceedings before the competent court under applicable consumer law. In B2B relations, the courts of Reggio Emilia have exclusive jurisdiction, unless otherwise agreed in writing.
The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. Consumers may consult recognised alternative dispute resolution bodies through the European Commission's Consumer Redress portal.
20. Language
The website is published in English. Automated translations are provided for convenience only and do not constitute a country-specific legal adaptation. The reviewed English version is the official version, subject to any mandatory language rights available to consumers.
21. Changes
Illustar may update these Terms for legal, technical or commercial reasons. The version applicable to an order is the version accepted at the time of purchase. Changes do not retroactively reduce rights already acquired.
